More about A Critique of the Ruling of al-Taqlid

The author states, “One of the researching scholars amongst the people of knowledge requested me to compile a treatise for him that would contain affirmation of the truth regarding al-taqlīd, as to whether it is permissible or not, in a manner that no doubt would be left after it nor objection to it would be accepted. Since the questioner is one of the eminent scholars, the response will be in the manner of ilm al-munāẓarah (the science of dialectics).”

About the authors

Muhammad Ibn Ali al-Shawkani

Imam Muhammad ibn Ali ibn Muhammad al-Shawkani was a Yemeni jurist, mufassir, and mujtahid whose insistence on direct engagement with the Qur'an and Sunnah — rather than strict adherence to the established madhhabs — made him one of the most consequential figures in eighteenth- and nineteenth-century Sunni scholarship. Born in 1173 AH / 1759 CE in the village of Shawkan, north of Sana'a, he was raised in a Zaydi (Shi'i) scholarly milieu but moved increasingly toward what would later be characterized as a Sunni-leaning, ijtihad-centered approach to Islamic law.

Al-Shawkani served for nearly forty years as the chief judge (qadi) of Sana'a under the Qasimid imams of Yemen, a position from which he exerted enormous influence on Yemeni intellectual and legal life. His major works include Nayl al-Awtar — a vast hadith-based commentary on Ibn Taymiyya's grandson Majd al-Din ibn Taymiyya's Muntaqa al-Akhbar, widely regarded as one of the most comprehensive Sunni works of practical jurisprudence based on hadith — and Fath al-Qadir, an extensive Qur'anic commentary that combines tafsir bi-l-ma'thur (transmitted exegesis) with rigorous linguistic analysis. He also authored Irshad al-Fuhul on the principles of Islamic legal theory and al-Sayl al-Jarrar, a critique of the dominant Zaydi fiqh manual.

Al-Shawkani's call for ijtihad and his critique of taqlid (uncritical adherence to legal authority) drew both deep admiration and sharp opposition in his lifetime, and his works became foundational reading for nineteenth- and twentieth-century Salafi reformist movements that emerged in Egypt, the Hijaz, and the Indian subcontinent. He died in Sana'a in 1250 AH / 1834 CE. His writings remain in continuous publication and study across the Sunni world.
